Washington In yet another immigration-friendly move, the Biden administration has agreed to give automatic work authorisation permits to consorts of H-1B visas holders, a step that would profit thousands of Indian-American women The agreement in this regard was reached by the Department of Homeland Security in a class- action action, which was filed by the American Immigration Attorneys Association (AILA) on behalf of indigenous consorts this summer.
“This (H-4 visa holders) is a group that always met the nonsupervisory test for automatic extension of EADs ( employment authorisation documents), but the agency preliminarily banned them from that benefit and forced them to stay for reauthorisation. People were suffering. They were losing their high- paying jobs for absolutely no licit reason causing detriment to them and US businesses,”Jon Wasden from AILA said The action successfully achieved the reversal of the US Citizenship and Immigration Services (USCIS) policy that banned H-4 consorts from serving from the automatic extension of their employment authorisation during the pendency of stage-alone EAD operations.
“Although this is a giant achievement, the parties’ agreement will further affect in a massive change in position for the USCIS, which now recognises that L-2 consorts enjoy automatic work authorisation incident to status, meaning these consorts of superintendent and directors will no longer have to apply for employment authorisation previous to working in the United States,”AILA said.
“We’re pleased to have reached this agreement, which includes relief for H-4 consorts, through our action sweats with Wasden Banias and Steven Brown. It’s gratifying that the administration saw that settling the action fornon-immigrant consorts was commodity that should be done, and done snappily,” said Jesse Bless, AILA director of civil action The Obama administration had given work authorisation to certain orders of consorts of H-1B visa holders. So far, further than H-4 visa holders, a significant maturity of whom are Indian-American women, have entered work authorisation.
